Biographical sketch: Union officer, journalist, lawyer, and Kansas State legislator.

Abstract: The collection ranges from personal correspondence to literary, legal, military, & U.S. commissioner of pensions communications and also includes clippings, court cases, letterpress & address books and personal diaries. Correspondence (1867-1911), diaries (1884-1908), military papers (1859-1888), memo & address books (1894-1909), court cases, certificates, and invitations relate to Eugene F. Ware's military career in Colorado, Dakota Territory, Iowa, Kansas, & Nebraska with the 1st Iowa Infantry Regiment and 4th & 7th Iowa Cavalry Regiments; his law practice in Fort Scott & other Kansas cities; his term as Kansas State senator (1879-83); and as pension commissioner (1902-5). Includes material on the Spanish American War and Topeka, Kan., floods (1903). Other topics include Fort Scott, autobiographical notes, poems & commentaries about poems, Kansas' quarter- and half-century of statehood celebrations, his nom de plume Ironquill, and controversy over his poem Dewey. Also included are clippings and other miscellaneous documents. The majority of personal correspondence is from 1904. During his last year as U.S. commissioner of pensions, Ware frequently wrote his wife, Jeannette, and his son, Gene, & daughter, Abby. Other correspondence includes letters written and received by his mother, Amanda, and his father, Hiram. Other correspondents include F. G. Adams, Arthur Capper, William Elsey Connelley, Charles S. Gleed, James W. Gleed, George Washington Glick, William Agnew Johnston, Chester I. Long, Preston B. Plumb, and Theodore Roosevelt.

Biog. Sketch (Full):

In Hartford, Connecticut, on May 29, 1841, Eugene Fitch Ware was born to Hiram and Amanda (Holbrook) Ware. The family soon moved in 1844 to Burlington, Iowa, where Eugene was educated in public schools and apprenticed in his father's harness making trade.

With the cannons on Ft. Sumter still echoing through the nation, Eugene enlisted in April 1861 with the First Iowa Volunteer Infantry. Subsequently he re-enlisted in the Fourth and later the Seventh Iowa Volunteer Cavalry where he served until the end of the Civil War. Commissioned as an aide-de-camp to four generals including Grenville M. Dodge, one of Sherman's commanders, Ware was badly wounded while on duty. The remainder of his 5 years in the military was spent in Sioux country fighting in the Indian Wars.

Returning to civilian life in 1866, Ware was employed on the writing staff of The Burlington (Iowa) Hawk Eye but reasons of health soon forced him to move to Kansas. In 1867 Ware arrived in Ft. Scott and was quickly employed on The Monitor where he later became editor. In 1871, however, Ware was admitted to the Kansas bar and left journalism to practice law. While at Ft. Scott, he married Jeanette Huntington on October 22, 1874. They had three girls: Abby, Nettie, and Millie; and one boy, Gene.

Law practice often paves the way to politics and in this Ware was no exception. In 1879 Ware began the first of three terms (1879, 1881 and 1883) in the Kansas State Senate. Always active, Ware sat on committees dealing with military affairs, corporations and manufacturers, and a host of other assemblies. During his terms of office, Ware introduced bills concerning railroads, life insurance, militia, and relief and support of the poor as well as bills of a more local nature.

Ware moved to Topeka in 1893 to become a partner with Charles Gleed and his brother, James, forming the law firm of Gleed, Ware and Gleed.

Of special note is Ware's literary development from the 1871 publication of "Neutralia," his first poem to win more than local acclaim, to his final work, The Indian War of 1864. Other works published in his lifetime were The Rymes of Ironquill, a book of verses that had 14 editions since the original in 1885, From Court to Court, a legal handbook published in 1901, and Sthuriel marketed in 1909.

In his last years Ware moved to Kansas City where he established yet another law firm with his son and son-in-law Ralph Nelson. Here he worked until his retirement at 70 to his farm in Cherokee county. While on vacation in Cascade, Colorado, Ware suffered a heart attack and died the morning of June 1, 1911. He was buried July 5 at Fort Scott National Cemetery.

Scope and content:

The papers of the Eugene F. Ware Collection span the years 1895 – 1939 although the bulk of material dates from 1895 to 1911. Contained within the 29 boxes and 1 tube is mostly correspondence of a personal or professional nature while letterpress and address books, clippings, diaries, court cases and miscellaneous documents comprise the remainder of the collection.

Letters of a personal nature are found sporadically throughout the collection, but the majority are in the Pierce contribution (the first 3 boxes) and were written in 1904. During his last year as commissioner of pensions, Ware frequently wrote his wife, Jeanette, and also his son, Gene, and daughter, Abby. Other correspondence includes letters written and received by his mother, Amanda, and father, Hiram.

The military papers for 1859 – 1888 describe not only the time of Ware’s service with Iowa units but include communications after his discharge. This section contains quartermaster accounts and returns, orders, promotions, recommendations, muster rolls, military communiqués, office memos, and telegrams. Although there is one letter received from Gen. Grenville M. Dodge, the correspondence is usually of a routine nature concerning Ware’s positions as a quartermaster, engineer, and aide-de-camp. Materials relating to his Grand Army of the Republic activities are found throughout the collection.

In the professional papers category are the communications relating to the three law firms in which Ware was a partner. During his legal career, Ware was appointed a deputy to assist the district attorney was approved to argue cases before the Supreme Court. A large portion of the material in this section relates to these activities. Included are case descriptions and briefs, records, and correspondence, especially in the letterpress books for the years 1883, 1893 – 1894 and 1901 – 1903. Also there are letters from individual clients, business concerns, corporations; documents containing judicial statements and affidavits; and telegrams. Significant cases such as Kansas v. Colorado in a major water dispute and an insurance company’s cases take up large portions of these files. Of great interest are the numerous letters from Charles S. Gleed and James Willis Gleed, Ware’s friends and business associates.

The political and governmental papers document Ware’s years as a State senator and commissioner of pensions, his bid for the Republican nomination for Congress, and his two times as a delegate to the Republican National Convention. Correspondence concerns political campaigns, the years as commissioner of pensions, and communications with other State departments. Also Ware’s three terms as a State senator are well covered. Of particular interest are the communications from President Theodore Roosevelt. They regard Ware’s appointment and work as a commissioner and a letter Roosevelt wrote him on his retirement. Prestigious correspondents include Kansas United States Senators Preston B. Plumb and John J. Ingalls and Charles F. Scott.

Information in the final category, literary papers, traces Ware’s rise as a publicly acclaimed author. Although a great many letters are between Ware and his Chicago editor Kellam concerning layout, form, and publication dates, the greatest portion of correspondence is from his admirers and readers. Myriad requests for copies of his work fill the collection along with congratulatory letters, critiques and often poetry from other people.

In the remainder of the collection are clippings, diaries, address books and a rolled document. The newspaper clippings (box 2) are articles written about Ware and cover the major aspects of his life. However there are a few articles on Jeanette Ware concerning her work on the Kansas Women’s Council. The newspapers represented are from Kansas and Washington. Although the material in the address books (box 27, 13 vols.) is self-evident, the diaries are not so conclusive. Ware used his diaries as an appointment agenda recording arrivals, departures, and meetings, rather than as an intimate journal. Infrequently there is a departure from this pattern as in the births of his children and death of his father. Finally the rolled document is a testimonial of respect and appreciation presented to John P. Usher, head of the Department of the Interior. Presented on May 13, 1865, there are over 50 signatures on it of which Ware’s is one.
