State Tax Credit Transfers

The Kansas Historic Rehabilitation Tax Credits may be sold or transferred to any interested buyer.  Credits can be used to pay a balance of income, premium, or privilege taxes owed to the State of Kansas.

Preparation

If the owner of the credits wishes to sell, it is up to that owner to find a buyer for the credits and work out a legal agreement regarding the sale. The following document contains contact information for people and entities who have expressed an interest in buying Kansas historic tax credits. Other taxpayers are also eligible to purchase or receive transferred credits.

The following is a sample agreement between two parties outlining the conditions of a transfer. This document is provided as a courtesy example. Transfer agreements should be worked out with the assistance of your legal or tax advisor.

Submission of Transfer

Once an agreement has been reached between two parties, information must be submitted through the link above.  See the online form via that link for additional details required to submit the transfer request.

A $300 fee is required for the transfer of each project where the qualified expenses of the original rehabilitation project were greater than $50,000 (credit amounts greater than $12,500).  Please visit the online museum store to pay the fee.

Transfer Processing

When the SHPO office has received notification of the complete online submission and the transfer fee has been paid (if applicable), the SHPO office will work with the Kansas Department of Revenue to verify that the credit is available for transfer. Once verified, the SHPO will issue a new and unique certificate for the buyer to allow the credits to be used by the buyers/assignor.
